On November 12, U.S. EPA announced a final rule approving the Texas Railroad Commission’s application to administer permitting for Class VI underground injection wells under the Safe Drinking Water Act. Class VI wells are used to inject carbon dioxide into deep rock formations for long-term storage.
With this approval, Texas becomes the sixth state to receive primacy for the Class VI well program, joining North Dakota, Wyoming, Louisiana, West Virginia, and Arizona.
EPA’s Underground Injection Control website includes links to a pre-publication version of the final rule and EPA’s response to public comments on Texas’ application for primacy. The final rule will become effective 30 days after publication in the Federal Register.
