The South Dakota Department of Agriculture & Natural Resources worked with state legislators to pass Senate Bill 92, which requires certain operations that process or store manure or process water to operate under a water pollution control permit. The bill, which was signed into law by Governor Kristi Noem at the end of February, requires dairy digesters that deal with manure from large concentrated feeding operations or the equivalent number of animals to have a permit regardless of whether they are owned and operated by a permitted dairy.
The new law seeks to ensure that manure processing and storage structures, whether at a dairy or digester operation, are properly designed, constructed, operated, and maintained.
