The North Dakota Department of Environmental Quality (DEQ) has taken a major step toward running its own permit program for the management of coal ash in landfills and surface impoundments. On May 12, U.S. EPA announced its proposed approval of the DEQ’s coal combustion residuals (CCR) program. The agency is accepting comments on this proposal for 60 days and will hold a hybrid public hearing for interested parties to comment.
If the plan is approved, North Dakota would be the fourth state in the nation, after Georgia, Oklahoma, and Texas, to gain approval to operate a coal ash permit program.
