In December, the Indiana Department of Environmental Management (IDEM) Coal Combustion Residuals (CCR) rule was approved by the state Environmental Rules Board, allowing IDEM to prepare and submit it for U.S. EPA review and approval. Once submitted, EPA has up to 180 days to review Indiana’s CCR permitting program before issuing a final decision.
IDEM’s proposed rule would require any facility in Indiana with CCR units, as federally defined, to obtain a state permit. The program would include requirements for design, operation, groundwater monitoring, closure, recordkeeping, and financial assurance.
U.S. EPA is accelerating review of state CCR permitting program applications and encouraging additional states to pursue delegations. At the end of 2025, four states had received approval, with several others in progress. Learn more on EPA’s website.
