Next week, a new Ohio law regulating solid waste and debris will go into effect. The bipartisan Senate Bill 147, signed by Governor Mike DeWine on July 1, will direct solid waste management districts to collect new construction and demolition debris fees, with the proceeds divided between local health districts and the Ohio Environmental Protection Agency (Ohio EPA). Proceeds will be deposited in Ohio EPA’s Environmental Protection & Solid Waste Management Funds, where they will support a variety of programs including air pollution control, drinking water and groundwater programs, and small business compliance assistance.
The law will also update the structure of Ohio’s solid waste districts. Counties that are currently members of multi-county districts may now unilaterally withdraw following a resolution by that county’s board of commissioners. Additional provisions allow local governments to restrict out-of-district waste shipments; require detailed planning for recycling, debris diversion, and landfill expansions; and protect facility construction from zoning changes.
